These Terms of Use and Sale define the rules for the use of the website www.mbrojtjangazjarri.com, the submission of quotation requests, the ordering of products, the provision of services and the relationship between Albkos Safety™ and its customers.

By using this website, submitting a quotation request, placing an order or purchasing products/services from Albkos Safety™, you accept these Terms to the extent applicable to the specific relationship.

Albkos Safety™ is a company registered in the Republic of Kosovo and operates in the field of supplying fire protection, safety and rescue products, systems and services.

2. Scope of Application

These Terms apply to:

• the use of the website www.mbrojtjangazjarri.com;
• requests for information and quotations;
• orders of products through the website, email, telephone or other communication channels;
• the sale and delivery of products;
• the provision of technical, professional and consulting services;
• relationships with individual consumers and business customers, to the extent applicable.

If special terms have been agreed in writing for a specific quotation, contract, tender, commercial agreement or project, those special terms shall prevail over these General Terms only for that specific relationship.

3. Definitions

For the purposes of these Terms:

• “We”, “Albkos Safety” or “the Company” means Albkos Safety™.
• “You”, “Customer” or “User” means the natural or legal person who uses the website, requests a quotation, places an order or purchases products/services.
• “Consumer” means a natural person acting outside their trade, business or professional activity.
• “Business Customer” means a legal person, institution, enterprise or natural person acting for professional, commercial or business purposes.
• “Products” means equipment, systems, parts, accessories and other goods published or offered by Albkos Safety.
• “Services” means servicing, maintenance, inspection, testing, installation, training, design, documentation and other professional services offered by Albkos Safety.

4. Use of the Website

The website www.mbrojtjangazjarri.com is intended to present products, services, technical information, educational content and to enable communication with Albkos Safety.

You agree to use the website only for lawful purposes and in accordance with these Terms. Any use that may damage the operation of the website, its security, the rights of Albkos Safety or the rights of third parties is prohibited.

Albkos Safety may suspend or restrict access to the website in the event of misuse, attempted unauthorized access, violation of these Terms or actions that may harm the security and operation of the website.

5. Information About Products and Services

Albkos Safety aims to ensure that information about products and services is accurate, clear and up to date. However, due to technical changes, manufacturer updates, catalogue updates or unintentional errors, the information on the website may require verification before the final order is confirmed.

Product photos, illustrations and graphic images are indicative and may differ from the final product in terms of color, shape, accessories, configuration, packaging or technical details.

6. Quotation Requests and Orders

The submission of a quotation request through the website, email, telephone or other communication channels does not automatically constitute a contract between the parties.

A contract shall be considered concluded only when Albkos Safety confirms the order in writing, accepts payment where advance payment is required, or when the parties agree on the quotation, price, supply/service terms and other applicable conditions.

Albkos Safety has the right to refuse or not proceed with an order in cases where:

• the product is not available;
• there is an obvious error in the price, description or specification;
• the customer’s data is incomplete or inaccurate;
• there is a reasonable suspicion of misuse, fraud or unlawful ordering;
• the order relates to products or services requiring prior technical verification;
• the supply or service cannot be carried out for objective reasons.

7. Prices

The prices published or offered by Albkos Safety are expressed in euro (EUR). Unless otherwise specified, prices include Value Added Tax (VAT).

Transportation, installation, servicing, maintenance, training or other additional service costs may be calculated separately, depending on the location, nature of the service and terms agreed with the customer.

Albkos Safety reserves the right to change prices at any time. For confirmed orders, the prices accepted at the time of order confirmation shall apply, except where an obvious technical or human error has been identified.

In the event of an obvious pricing error, Albkos Safety will notify the customer and offer the option to confirm the order at the correct price or cancel it.

8. Payment

Payment for products and services shall be made according to the method specified in the quotation, invoice, order confirmation or payment options provided on the website.

Payment methods may include, depending on the case:

• cash payment, where permitted and applicable;
• bank transfer;
• electronic payment, if enabled by the website;
• other methods agreed in writing between the parties.

The order or service may be processed only after payment has been confirmed, where advance payment is a condition for carrying out the order.

Albkos Safety may suspend supply or service provision in the event of non-payment, delayed payment or failure to comply with the agreed payment terms.

9. Delivery and Acceptance of Products

Products shall be delivered to the address specified by the customer or may be collected at the location of Albkos Safety, according to the agreement between the parties.

The customer is responsible for providing the correct address, telephone number and other information necessary for delivery.

Delivery times are indicative unless expressly confirmed in writing as binding deadlines. Delivery may be affected by product availability, location, transport conditions, customs procedures, suppliers or other objective circumstances.

The customer must inspect the product at the time of receipt. If visible damage, shortages or discrepancies are noticed, the customer must notify Albkos Safety as soon as possible and, where possible, before signing the delivery acceptance document.

10. Right of Withdrawal for Consumers

If the purchase is made by a consumer through a distance contract, the consumer has the right to withdraw from the contract within the legal period of fourteen (14) days, without giving any reason, except in cases where the law provides for exceptions.

The withdrawal period usually starts from the day on which the consumer, or a person designated by the consumer, receives the product. To exercise the right of withdrawal, the consumer must notify Albkos Safety with a clear statement of their decision to withdraw from the contract.

The right of withdrawal may not apply, among others, in cases where:

• the product has been manufactured, customized or specially ordered according to the consumer’s requirements;
• the product has been used beyond what is necessary to verify its nature, characteristics and functioning;
• the product has been damaged after receipt by the consumer;
• the product is not in suitable packaging and condition for return;
• the service has been fully performed with the consumer’s prior consent, where the consumer has been informed that after full performance of the service they may lose the right of withdrawal;
• other exceptions provided by applicable legislation apply.

For business customers, the automatic 14-day right of withdrawal does not apply unless otherwise agreed in writing.

11. Returns and Refunds

When the consumer exercises the legal right of withdrawal, the product must be returned without undue delay and within the period provided by law, in suitable condition, unused, undamaged and, where possible, with the relevant packaging, documentation and accessories.

The cost of returning the product shall be borne by the consumer, except where the product was delivered incorrectly, has a confirmed defect or has been otherwise agreed.

The refund shall be made after receipt and verification of the returned product, using the same payment method used by the consumer, unless the parties agree otherwise.

Albkos Safety may refuse the return or reduce the refund amount if the product has been used, damaged, parts are missing, documentation is missing or the product has been returned in a condition that reduces its value beyond normal inspection of the product.

12. Defects, Non-Conformity and Warranty

Albkos Safety handles requests related to defective, damaged or non-conforming products in accordance with applicable legislation and the manufacturer’s warranty terms, where such warranty exists.

The customer must notify Albkos Safety as soon as possible after identifying a defect, damage or non-conformity, providing a description of the issue, photos where possible, proof of purchase and any other information necessary for verification.

The warranty does not cover damage caused by:

• incorrect use or use contrary to the manufacturer’s instructions;
• installation or intervention by unauthorized persons;
• mechanical, accidental damage or misuse;
• irregular maintenance or lack of periodic inspection;
• use in unsuitable technical or environmental conditions;
• force majeure or events beyond reasonable control.

13. Technical and Professional Services

Albkos Safety provides technical and professional services in the field of fire protection, including servicing, maintenance, inspection, testing, installation, design, training and documentation, according to its authorizations, capacities and agreed terms.

Services are carried out based on the information provided by the customer, the actual condition on site, technical requirements and the terms agreed in the quotation or contract.

The customer is responsible for ensuring access to the facility, accurate information, the necessary technical documentation and suitable conditions for the performance of the service.

Reports, certificates, recommendations or other documents issued by Albkos Safety reflect the condition identified at the time of inspection, testing or service, unless otherwise specified in writing.

14. Safe Use of Products

Fire protection products must be used, installed, maintained and inspected in accordance with the manufacturer’s instructions, technical standards and applicable legal requirements.

Certain products or systems may require selection, installation, servicing or maintenance by qualified or authorized persons. Albkos Safety is not responsible for damages resulting from incorrect use, unprofessional installation, unauthorized interventions or failure to follow technical instructions.

15. Limitation of Liability

Albkos Safety does not exclude or limit liability in cases where such limitation is not permitted by law.

To the extent permitted by applicable legislation, Albkos Safety shall not be liable for indirect losses, loss of profit, business interruption, loss of data or damages that were not a direct and foreseeable consequence of its action or omission.

The customer is responsible for using the products and services in accordance with their intended purpose, technical instructions, professional recommendations and applicable legal requirements.

16. Website Availability and Interruption

Albkos Safety undertakes to keep the website functional and accessible, but does not guarantee that the website will always be uninterrupted, free of technical errors or external disruptions.

The website may be temporarily interrupted for maintenance, updates, improvements, security reasons or causes beyond the control of Albkos Safety.

The user is responsible for using appropriate devices, software and security measures to protect against technological risks, including viruses, malware or cyber-attacks.

17. Intellectual Property

The customer has the right to submit a complaint regarding products, services, delivery, invoicing or other matters related to Albkos Safety.

21. Force Majeure

Albkos Safety shall not be liable for delays, inability to supply or failure to perform obligations where this is caused by circumstances beyond the company’s reasonable control.

Force majeure may include, among others: natural disasters, fire, floods, epidemics, war, unrest, strikes, power outages, transport disruptions, supplier delays, administrative restrictions, government measures or other unforeseeable events.

In the event of force majeure, Albkos Safety will notify the customer as soon as reasonably practicable and will take reasonable measures to reduce the consequences.

22. Changes to the Terms

Albkos Safety may amend or update these Terms from time to time to reflect changes in legislation, services, website operation or business needs.

The updated version will be published on this page and will enter into force from the date of publication.

Changes shall not apply retroactively to orders or contracts confirmed before the publication date of the new version, except where required by law or otherwise agreed by the parties.

23. Partial Invalidity

If any provision of these Terms is considered invalid, unenforceable or contrary to law by a competent authority or court, the remaining provisions shall remain in force and enforceable.

24. Applicable Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the legislation of the Republic of Kosovo.

Any dispute arising from the use of the website, orders, products, services or these Terms shall first be attempted to be resolved amicably between the parties.

If an amicable resolution is not possible, the dispute shall be subject to the competent court in the Republic of Kosovo, unless otherwise provided by applicable legislation.

25. Language of the Terms

The official version of these Terms is in the Albanian language. If these Terms are translated into other languages, in case of any inconsistency between versions, the Albanian version shall prevail, to the extent permitted by law.
